HEIR OF DECEASED APPLICANTS

I decided to publish this in PH678 Viber Community, not only for new AFPOVAI Lot applicants, but for the heir of AFP Officers who already passed away, while waiting for the lifting of the series of suspension in the release of their AFPOVAI Lot titles.

This is a legal opinion from a lawyer who said that the suspension done for many years can be, not only unfair, but unjust.

The Lawyer, give me the following brief history to justify what he told me.

1. In July 1957, a Presidential Proclamation No. 461 was released. Among other provisions, it declared that 148 hectares of Fort Bonifacio Land, will be an Officers Village.

2 The purpose of this Officers village is to provide a decent place of habitat and fitting tribute to retired and active members of the AFP/PNP who meritoriously rendered the noblest services to the government and the Pilipino people.

3. However, on Oct 1993 a Memorandum order No. 172 was released that prohibits the issuance of a deed of sale of Lots in the officers Village, for an alleged anomalies.

4. This prohibition lasted for more than 7 years. This was unfair to the 2,382 Lot applicants, who are bona fide members of the retired and active officers of the AFP/PNP.

5. After 7 years, this prohibition was lifted thru a Memorandum Order No. 126 dated Dec 2000. This was lifted during the time of President Erap Estrada. (See attached below the Memorandum)

6. While the issuance for a deed of Sale of Lots located inside the Golf Course, was still in progress, a Suspension Order was again issued. This was issued during the time of President Gloria Makapagal Aroyo.

7. This suspension Lasted for 17 years.

8. The Suspension was lifted, just two months ago, with a Memorandum dated March 2022. (See attached below the Memorandum)

9. However, maybe some envious government official can still suspend it, but they cannot cancel it, because it is already part of the Law, thru a series of Republic Act, Presidential proclamation and Memorandum.

10. If it will be suspended again, it is not only unfair, but unjust, to many retired and active members of officers in the AFP/PNP.

Therefore, do not lost hope, specially the heirs of departed AFP/PNP Officers. Officers who meritoriously rendered the noblest services to the government and the Pilipino people.

It is your lawful right to have this AFPOVAI Lots.
